TERMS OF TRADING
On placing an order with the Company the buyer shall be deemed to have agreed to the Company's Terms of Trading.
Title and ownership:
1. The risk in the goods shall pass to the buyer on delivery.
2. Title/ownership of the goods delivered shall remain the property of the Company until paid for in full.
3. The buyer shall store the goods so as to make them readily identifiable as being goods belonging to the company until full payment has been made.
4. The buyer shall hold the proceeds of sale of unpaid goods as agents for the Company
and shall ensure that they remain identifiable as such.
5. In the event of the buyer failing to make payment in accordance with the Company's Terms of Trading or if the buyer is in receivership or has a winding-up order made against it, or calls a meeting of its creditors or is in any way insolvent then the Company shall immediately be entitled to enter upon the buyer's premises to re-possess the goods and the buyer shall identify the goods to the Company and provide it with every facility and co-operate fully to remove the goods.
PAYMENT TERMS
New Accounts: Payments with order or on delivery as agreed.
Approved accounts: Payments within 21 days of date of despatch. Any trade and discount terms given are allowed strictly for payment by the date stated, then within 7 days are due strictly net and thereafter are overdue.
OVERDUE ACCOUNTS (including V.A.T.)
Overdue accounts are liable to an interest charge of 2% per month or part thereof until payment is made.
No receipt of payment will be issued unless requested.
Payment: may be made by cheque, most credit or debit cards such as VISA, Mastercard, Solo, Switch and Maestro. We will charge a 4% handling charge for any customers wishing to pay by American Express or Diners Club cards.
BACS payments should be made to NatWest Bank Plc, Sort Code: 53-61-38, Account No: 66503469.
V.A.T. is calculated on the discounted value where applicable.
PRICES
All prices are correct at the time of going to press. It is the Company's intention to hold prices firm for as long as possible, but the Company reserves the right to change prices without prior notice and goods will be invoiced at the price ruling at the date of despatch.
All prices are exclusive of V.A.T. which will be charged in addition at the current rate.
DISCOUNTS
Bulk supplies and large orders may be subject to a special quotation. Special offers or discounts may apply from time to time as indicated.
SMALL ORDER CHARGE
Due to administrative, handling and carriage costs, orders below £250 will incur a surcharge of £17.00 exclusive of V.A.T.
CARRIAGE
Orders to the value of £250 and over (exclusive of V.A.T.) are carriage paid except for items marked * (carriage extra) in the price list which are subject to manufacturer's ex-works carriage charges. We are able to offer a special next day delivery, if required, at an extra cost, which will be advised when you place your order.
FORCE MAJEURE
Orders are accepted subject to force majeure and subject to supplies being available. The company has the right to suspend partially or totally cancel any orders it may have on hand, at any time should prevention or hindrance to manufacture or delivery be caused by any circumstance whatsoever.
COLLECTION OF GOODS
Collection of goods from our warehouse can be made subject to prior arrangement. Please ensure that the necessary identification and documentation is available for collection of goods.
DESPATCH AND INVOICING
A delivery note accompanies all goods dispatched. Invoices are mailed promptly thereafter.
DELIVERY
Kerbside deliveries only where no vehicular access exists, unless otherwise arranged. Vehicles ordered off the public highway at buyer's risk and cost. Bulk deliveries to hard standing only, otherwise additional risk of delays and damage at buyer's risk and cost. Pallets delivered are charged at cost where applicable. Return of pallets carriage paid for credit at buyer's risk and cost.
NON-DELIVERY, SHORTAGES, INCORRECT OR DAMAGED GOODS
If goods are not received within 7 days from date of invoice, the Company must be notified immediately in writing, otherwise no responsibility can be accepted. Notification of the receipt of damaged goods must be made to the carrier immediately and to the Company within 48 hours. Short delivery of goods must be recorded at the time of delivery and must be notified in writing within 3 days thereof. No claim may be entertained unless notification has been made within the time limit set. Goods signed for as "not checked" or "unexamined" or similar will be regarded as being given a clear signature. It is the responsibility of the user to check the goods delivered prior to using, no responsibility will be accepted by the company for wrongly delivered goods. Delivery note numbers must be quoted on all notifications.
Please note: Failure to comply with this procedure or late notification will invalidate your claim.
RETURNS
No goods can be accepted back for credit without permission and a minimum 20% handling charge will apply. The credit will be dependant on the condition of goods returned. The responsibility for the cost of returning goods rests with the customer. These charges do not apply where there is a justifiable complaint against the quality of the goods.
QUALITY
The company reserves the right to use alternative materials and to alter the design and range of equipment without notice when the company finds them more suitable or necessary.
WARRANTY
All goods are supplied by us in good faith as suitable for the purposes indicated on the labels or in the literature. However with specific reference to Collier Turf Care Ltd. products, as we cannot exercise control over their mixing or use, and with general reference to Collier Sports & Leisure products all conditions and warranties statutory or otherwise, as to the quality or fitness of our goods for any purpose, are excluded and no responsibility will be accepted by us for any damage or injury arising from their storage, handling, application, or use except insofar as such exclusion is prevented by English law. Any liability in respect of the quality of fitness for the purpose of goods supplied shall not extend to loss of profits or any other consequential financial loss.
VARIATION OF TERMS
The above Terms and Conditions govern all transactions between the customer and Collier Turf Care Ltd and Collier Sports & Leisure (referred to as "the Company") except as otherwise specifically agreed in writing by the Company and to the exclusion of any other terms even if those terms are contained in any of the customer's document that purports to provide that the customer's own terms shall prevail.
VALUED ADDED TAX
All prices quoted are subject to V.A.T. at the current rate, where applicable (Grass seed is zero rated)

HOW TO ORDER
We will accept customers' official order forms provided that the following details are provided:
1. A signature by the authorised buyer.
2. Collier Sports & Leisure item codes are used.
3. Full details of colour, size, style, quantity are supplied (where applicable).
4. Full delivery and invoice addresses and telephone numbers are given.
5. Any instructions regarding delivery or special quality requirements are stated.
6. You clearly state your account number.
FAILURE TO PROVIDE THE ABOVE INFORMATION WILL RESULT IN YOUR ORDER BEING DELAYED.
ORDERS BY TELEPHONE OR FAX
We accept such orders only on the basis that an official order number reference can be given at the time the order is given. Known account customers should give an official order number and an account number on placing an order.
In the event of a telephone or fax order being accepted, any written confirmation received thereafter must clearly show the words "FOR INFORMATION ONLY - CONFIRMATION OF TELEPHONE/FAX ORDER". Failure to follow this procedure may lead to duplication of the order and retrieval charges being incurred by the customer.
STOCK AVAILABILITY
Stock changes daily, but our manufacturer's extensive 12,000m2 approx. of factory manufacturing space enables fast, efficient production of high quality products. For advice on stock availability, please call our office or leave a message on our 24hr. answerphone and we will answer your query.
DESPATCH DATE AND DELIVERY
We endeavour to despatch goods on the same or next day of receipt of order, and delivery of goods is normally within 3 working days. Where indicated, larger items and specially made items (e,g, cricket nets and tennis surround netting) are subject to a delivery time of 2-3 weeks.
Please note that our carriers deliver weekdays between 9am and 4pm Monday to Friday. We can arrange delivery at other times by prior arrangement only. If the delivery point is likely to be unmanned, you should include instructions to guarantee an authorised signature will be available/present upon delivery of goods. Abortive deliveries may be subject to a charge being made if instructions are not included in your order or not adhered to as stated in your order. A delivery note accompanies all goods dispatched.
CARRIAGE
Orders to the value of £250 and over (exclusive of V.A.T.) are carriage paid except for items marked *)(carriage extra) in the price list which are subject to manufacturer's ex-works carriage charges. A surcharge is made on carriage of football and rugby posts to destinations in Devon, Cornwall, Wales and Scotland and all destinations outside mainland U.K. In some cases, we are able to offer a special next day delivery, if required, at an extra cost.
GUARANTEE
All items shown in the Collier Sports & Leisure Product Guide are guaranteed for one year from date of invoice, subject to the following:
The Company will repair, or at its own discretion replace any goods which are proved to the reasonable satisfaction of the Company to be defective in material or workmanship (fair wear and tear excepted) and re-perform or at its own discretion remedy any works which are proved to the reasonable satisfaction of the Company to be defective in workmanship. Any considered defects must be notified to the Company in writing within 12 months of the date of the Company's invoice for the goods. The guarantee is offered as an extra benefit and is additional to the customer's statutory rights.
